Employment Relations Boards reaffirms that PSU Admin violated state law and your contract
Though the administration tried to appeal the original decision, the state’s Employment Relations Board (ERB) reiterated that PSU’s leadership engaged in bad-faith bargaining during the 2025–2026 contract campaign, interfering with your union’s ability to improve your working conditions and administer your collective bargaining agreement. These actions, along with admin’s withholding of your benefits funds in violation of the integrity of your contract, testify to the pattern of destruction and waste that has come to characterize President Cudd’s tenure at this institution.
Official notice of PSUFA’s ULP victory
ERB’s latest ruling orders the university to cease and desist from its unlawful actions, to provide crucial information about adjunct job security that your union has been requesting since as far back as December of 2024, and to engage in a good-faith effort to address the financial cost to your union of administrative delays in processing members’ dues deductions. The decision also requires PSU leadership to publicize a notice of this unfair labor practice ruling, which should have been sent to you by email and posted on campus in adjunct work spaces. (If you haven’t seen a notice posted in your program’s adjunct offices or equivalent locations, please let us know at communication@psufa.org).
This decision is a reminder of the current leadership’s misplaced priorities. While clinging to its austerity narrative, the Cudd administration continues to waste precious time and pour critical resources into outside legal fees to defend its foolhardy and unlawful actions. The decision, though, also reminds us of the strength of our collective power. Again and again, you and your fellow adjuncts have stood up to President Cudd, never allowing her administrators and lawyers to divide us. It’s our solidarity that allows us to fight back and win.
